It is a special stamp, which in accordance with the Convention of the Hague about remission of requirements to legalization of foreign official documents, executed on October 05, 1961 (effective for the Russian Federation since May 31, 1992) is affixed on official documents, outgoing only from institutions and organizations of the Russian Federation in the capacity of a member of the Convention of the Hague, and does not need any further certification or legalization, it is acknowledged by the authorities of all states – members of the Convention.

The sample of the apostille is established by the Convention, revoking the requirement for legalization of foreign official documents (concluded in Hague 05.10.61, effective for Russia from 31.05.92): The apostille has the form of a quadrate with the side not less than 9 sm.

The documents, issued and having validity on the territory of one state, may be used on the territory of another state only after their legalization in the established order, if otherwise is not provided by the legislation of the states or the provisions of the international agreement, abrogating the procedure of legalization, the participants of which are the states. At present two methods of such a certification received extension – consular legalization and affixing of apostille.

The documents, issued in Russia and meant for presentation to the authorities of other countries (participants of the Hague Convention) are certified in a special, simplified order: authorities of Russia affix special stamp (apostille), which does not demand further confirmation or legalization and is acknowledged by the official institutions of all the countries – participants of the Convention. According to art. 9 of the Hague Convention each contracting state takes necessary measures so, that its diplomatic or consular agents shall not execute legalization in those cases, when the Convention provides release of it. The apostille certificates the authenticity of the signature, the capacity of the person, who has signed the document, and in the proper case, the authenticity of the seal and the stamp, which has affixed this document. (art.5).

The action of the Hague Convention spreads to the documents about education, civil status, record of work, certificate of being alive, references, powers of attorney, judicial decisions and materials for civil, family and criminal affairs.

The apostille is not affixed on the documents of diplomatic and consular institutions, bank references, commercial correspondence, documents, having direct relation to commercial and customs` operations (powers of attorney and bills of lading for the transportation of the goods across the border, agreements about the delivery of the goods and rendering services, or performance of the works and accounts for them, etc.).
